What is a "Proof of Claim"?

A Proof of Claim is a document that notifies the bankruptcy Court, the bankrupt debtor, and other creditors that you have a monetary claim against the bankrupt debtor. The Proof of Claim also notifies all parties of the amount of your claim. The filing of a Proof of Claim is often extremely important, as the failure to file a Proof of Claim by the deadline can result in grave consequences to a creditor.


A Proof of Claim often gets filed by creditors in Chapter 13 and Chapter 11 bankruptcy cases. Chapter 7 bankruptcy cases often do not require the filing of a Proof of Claim if the bankrupt debtor does not have any assets, and the Trustee did not inform the creditors that there are assets that are available to pay creditors.


There is always a deadline set in Chapter 13 and Chapter 11 bankruptcy cases to file a Proof of Claim, and thus, it is important that this deadline is followed.


What is an "Objection to Proof of Claim"?

While a Creditor can file a Proof of Claim, Debtors and Trustees have the right to object to a Proof of Claim filed by the creditor. An Objection to Proof of Claim can be filed by a Debtor if he/she does not agree with the amount of claim listed by the creditor on the Proof of Claim. To contest an Objection to Proof of Claim, the Creditor needs to oppose the Objection, and then often appear at hearing(s) before the Judge. The possibility that an Objection to Proof of Claim will be filed is another reason why you should consider hiring an attorney to help you prepare (and file) the Proof of Claim.
