What is an "Adversary Proceeding"?

To simplify, an adversary proceeding is a lawsuit that is filed in a bankruptcy case. An adversary proceeding can be filed by a Trustee to recover property that was transferred by the bankrupt debtor shortly before the bankruptcy. Other examples of adversary proceedings are those filed by Creditors who seek to have a debt deemed "non-dischargeable."


In other words, a creditor can file an adversary proceeding against a bankrupt debtor and ask the Court to exclude that specific debt from being affected by the bankruptcy. Since the goal of every bankruptcy (for the Debtor) is to receive a discharge, a creditor which is successful at deeming a debt non-dischargeable effectively has its debt excluded from the bankruptcy discharge - i.e. the debt does not get wiped out. 


Finally, a creditor may also choose to file an adversary proceeding to object to a debtor's receipt of a discharge. Thus, instead of just asking the Court to deem a single debt non-dischargeable, the creditor seeks to have the Court find that the debtor should not receive a bankruptcy discharge at all, against ALL debts.



Are Adversary Proceedings in Bankruptcy Difficult?

The short answer is: yes. Adversary Proceedings are usually an "uphill battle" for creditors. The burden that the Creditor has to satisfy is high. Additionally, there are various technicalities that must be followed. The process can be lengthy and requires the skill of a competent bankruptcy attorney who knows bankruptcy laws, and is equipped to handle litigation in bankruptcy (not all bankruptcy attorneys can, or do, handle adversary proceedings).
